A trademark is a sign to identify the goods or services offered by an individual or a company, which shall refer to any sign with distinctiveness.

The Types of TrademarksTraditional Trademarks:
A mark used in goods and/or services, in order to enables consumers to identify the source of goods or services.

Collective Trademarks:
A mark registered in the name of any association, group or other organization in order to be used by the members thereof to indicate their membership of such organizations.

Collective Membership Marks:
A mark registered by any organization capable of supervising certain goods or services and used by entities or individual persons outside the organization for their goods or services to certify the origin, material, and mode of manufacture, quality or other characteristics of the goods or services.

Basic Documents Required

ID Proof

If the Applicant is a company, we need the Scanning copy of the Business Certificate. If the Applicant is a natural person, we need the Scanning copy of the passport.

Name & Address

If the Applicant's name and the address are in English or other languages, please provide the name and Address and translate in Chinese. We can also help you wigh translation.

Brand Sample

The size of Trademark Brand design samples (name or logo or design) should be not less than or equal to 5×5 cm and not more than or equal to 10×10 cm. (Or picture with jpg : 500*500pixel to 1600*1600pixel  ). If the sample is in color, we need the color sample and also one sample in black and white.

Power Of Attorney

Power of Attorney (POA) duly executed by the applicant (Enclosed). It means that you just need to sign or seal the POA that we provide.

Procedure

1. Free Trademark Search

2 Hour

You can contact us.  Our Trademark Attorney will perform a check the availability of the desired name or logo or design and provide you with a Search Report.

2. TM-1 Application Filing

1-3 Working Days

When we ensure that the mark can be used in China, we will send you a Power of Attorney (POA) which must be duly signed by you and return to us. After that, the TM attorney will file a Trademark application to the Trademark Office on behalf of our customers. Meanwhile, we will provide you the receipt of the Trademark Filing application.

3. Form Examination

3-4 Weeks

The application date of Trademark Registration shall be subject to the date when the Trademark Office receives the application, and the China Trademark Office (Govt) will verifies the application. If there are no questions, the Trademark office shall issue a Notice of acceptance for the application and our attorney will send it to you by email. Once the Mark gets registered, you can start using the 'TM' symbol with the brand name.

4. Substantive Examination

3 Months

The China Trademark Office examiner (Govt) verifies the TM application. After, they will issue a Notice of preliminary examination approval or reject the application.

5. Publication

3 Months

In case of no objection, the China Trademark Office (Govt) will publish an announcement. If there is no opposition, the government will approve the Trademark application and issue the Trademark Certificate.

6. Govt Approal

1 Month

Once the trademark gets registered and you receive the Trademark Certificate, you can start using the 'R' symbol with the brand name.
